The <br />following information should help you in your review of the <br />application. <br />1. SMC acquired the Somerset Mine and associated surface <br />facilities from I;aiser Coal Company late in 1989. The coal mine <br />and coal handling facilities are located just north of the town <br />of Somerset in Gunnison County. <br />2. The existing mine and surface facilities have not <br />undergone any major modification since 1970. These facilities <br />include a dump station, tipple, stockpile area and silo for unit <br />train loading. <br />3. SMC has been operating the surface facilities without <br />an air pollution emission permit under the assumption that one <br />was not required because the aurface facilities were in operation <br />prior to February ], 1972. <br />4. By certified letter dated November 19, 1990, the Colo- <br />rado Department of Health gave SMC an Official Notice of Viola- <br />tion for operating the surface facilities without a valid permit. <br />5. U.S. Steel constructed and commenced the operation of <br />the existing aurface facilities in the 1960's. Production re- <br />cords obtained from the Colorado Division of Hines indicates that <br />li.S. Steel mined and shipped 500,000 to over one million tons of <br />raw coal per Year from 1966 through 1985. A tabulation of the <br />historic production records is enclosed as Exhibit 4, <br />6. U.S. Steel delivered coal to a surface dump station <br />from the underground mine ~•ia open rail cars.
