III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was partial inspection conducted by Janet Binns of the Colorado Division of Minerals and Geology. <br />The mine is reclaimed, with no facilities and no personnel remaining on site. The mine was an <br />underground mine. The mine site was snow covered and temperature conditions were cold and slightly <br />cloudy. <br />Roads: The County Road is plowed and snow packed. As a result of County Road snow removal and <br />grading, the roadway dip is poorly defined. No ponding of snowmelt was noted as a result of the grading <br />down of the dip. <br />Hvdrolot?ic Balance: The pond is snow-covered with no indication of water below the snow.. <br />Slides: No new rockfall was observed on the reclaimed mine bench or backfilled outslope. <br />Records: Mine records were checked at the Routt County Courthouse. Mine records are kept in the vault <br />in the Routt County Clerk and Recorder's office. As noted in October 2000 complete inspection the <br />Instuance Certificate on file at the courthouse is outdated and inaccurate. This record needs to be updated <br />in the public record. Rule 5.02.4(1) State mine inspection reports need to be maintained in the public <br />record. The last DMG inspection report on file in the Routt County Courthouse for the Apex No. 2 Mine <br />is dated 8/17/99. This record is 16 months in arrears. Pond Inspection reports and DMR's are not on file <br />for the 4ih quarter 2000. The December 4, 2000 Midterm document is not on file at the courthouse.
