Cottony <br />Division Director <br />Natural Resource Trustee <br />The Division has reviewed the City of Golden's August 31, 2004 adequacy responses concerning fugitive <br />dust control and legal right of entry at the Empire Pit. The Division has no further adequacy comments <br />regazding legal right of entry. And, the Division appreciates Golden's past and planned strategies for <br />fugitive dust control of the stockpile azea. However, the Division requests that the City of Golden provide <br />a written commitment to apply reasonable dust control methods to the stockpile azea, as necessary, <br />throughout the life of the operation in order to minimize the potenfial for fugitive dust from the affected <br />lands. If the City of Golden wishes to apply dust control methods or strategies not akeady specified, the <br />Division requests that the City of Golden first notify the Division prior to implementation. <br />We would appreciate such written commitment for fugitive dust control on or before September 7, 2004. <br />hT the event that the current objector (Sally Buckland & Glenda Guanella) withdraw their objection in <br />writing on or before September 7, 2004 the Division will make a final decision on your amendment <br />application on September 10, 2004. <br />Once again, I will look forwazd to your response on or before September 7, 2004. Rule 1.8.1 states that <br />changes and additions to the permit application must be filed with the Division and the County Clerk and <br />Recorder. The applicant must also provide the Division with an affidavit or receipt demonstrating that the <br />change or addition was filed with the County Clerk and Recorder no later than the close of business on the <br />day the change was filed with the Division.
