Following are a few <br />items that need to be addressed in order to meet the minimum requirements of the Act/Mineral <br />Rules and Regulations: <br />1. Exhibit D -will the highwalls be mined at a 3:1 gradient during mining or will they be. <br />graded (cui and fill) when mining ceases in the various phases? <br />Please state the depth and thickness of the deposit to be mined. <br />Please describe the nature of the stratum imn3eadiately beneath the material to be mined. <br />2. Exhibit E -please provide a signed and notarized document from the landowner stating <br />that he wants the access road Left as is when mining ceases so he can access his property <br />on arE improved road. <br />There are two refuse piles (tree slash) located in the existing permit area. What does the <br />applicant plan to do with this material? If it is ground up it can be used for mulch during <br />reclamation. If it is not going to be used to mulch the area it must be removed and <br />properly disposed of. <br />3. Exhibit L - a financial warranty requirement will be calculated after you submit a <br />response to this adequacy letter. <br />Please file a copy of this letter and a copy of your response with the County Clerk and Recorder <br />and provide the Division with an affidavit or receipt demonstrating that a copy was filed with the <br />Clerk and Recorder. <br />Prior to final consideration of the application, you need to submit proof of publication and proof <br />of all required notices if you haven't already submitted them. <br />Be advised that the conversion application may be deemed inadequate, and your application may <br />be denied on September 7, 2004, unless the above noted adequacy items are addressed, or you <br />request additional time to respond, pursuant to provisions of Rule 1.4.1(9) <br />If you have any questions, please give me a call at 303-866-4060. <br />Office of <br />Mined land Reclamation <br />Ofnce of <br />Ac[ive and Inactive tilines <br />Colorado <br />Geological Survey <br />
