Brian Wood and 1 met with Tom Schreiner, Allen Sorenson, and Carl Mount nn
Friday, November 30, 2001 and presenled the requested modeling results. f.)trring this meeting we
discussed the major issues essocialed with our forensic analysis of the May 5, 2001 bank failure and
presenled our professional opinion that rite bank failure and resultant downsh'ratn damage was oat related
to existing location of the 13tr11 Seep.
With this letter and enclosures, Lidstone trod Associates, Tnc. (LA) responds to the Stttte of Colorado
Division of Mines and Geotugy (DMG) letter of November 21, 2001 (Schreiner to Hlekman). 'torn
Scltreincr's original letter nutliltcd six points. 1 ant addressing 1'uints 2, 3 and possibly 4,
Paint 2
It is my understanding that the original flood contml Icvice was constucted as a WPA levee sornetime in
tltc late 193Us or 1940s. Following the construction of the Brarttrtcr Diversion Structure, the fanners
adjacent to the arcs sued the Branmer Diversion Ditch Company, alleging that the Diversion caused flood
damage to their prnpcrry, Some of the flood scars from a 1949 event can be seen on the lurrc 21, 1950
photo (see Figure 2.1). 1 assume that the 1949 flooding and the fanners' cnrtccrns led to additional
construction and/or extension of the WPA tlnnd control levee in a rtortltward direction.
i have previously submitted the 1950 aerial photograph in a digital manner to Allen Sorenson. A rovit:w
of the June 1950 aerial phoWgraph suggests the presence of a ditch/swalc along the inboard side of the
levee. My assumption is that the individuals who constructed the levee, borrowed "fill" material from fire
inboud side of the Icvice. The photo doesn't suggest any other nearby burrow areas. This phuW indicates
that the levee extension was under construction as of rite date of this pltatn (6/21/1950). One cart see
what appears to be a flow line and sedimentation near fire downstream terminus of this structure. Tttis
sarnc area is now referred to as the "intersection of [hc Btrll Seep Drain and Bull Seep Slough".
This feature is also documented in rite pre-disturbance mapping of the area as sltowrt in Mobile Premix
Cortcreu: Pcnnit (M-78-052).
