Paving shall be one <br /> lane in width and, in addition, two passing points shall be provided. <br /> (3 . ) SAFETY - Nottingham will need to install, maintain and use a <br /> safety warning device at the top of the hill to prevent two vehicles <br /> from meeting on the hill. <br /> (4. ) LICENSE - The license shall be limited to Nottingham vehicles <br /> and shall be limited in duration, so that it expires when I-70 <br /> construction is terminated. <br /> If the above items are acceptable to your client, Please draft an <br /> Agreement for the Trustees to review. <br /> III. <br /> The Trustees would like to acquire the surface rights to the Nottingham <br /> gravel pit site. The Trustees contemplate that surface rights would <br /> not be effective until such time as Nottingham abandons its gravel <br /> operation. Please inquire of your client: (a) what the present <br /> purchase price of the future surface rights is, and (b) what arrange- <br /> ment can presently be made to confer a right or option to acquire <br /> surface rights in the future. <br /> IV. <br /> With respect to Nottingham' s application to the Colorado dined Land <br /> Reclamation Board for a permit to conduct sand and gravel operations, <br /> I have advised the Trustees that they have until February 21 , 1979 to <br /> file their objection to the proposed reclamation plan. It is therefore <br /> imperative that Nottingham provide specific information and adequate <br /> assurances to the Trustees regarding acceptable reclamation commitments <br /> prior to that date. In the absence of an Agreement between Nottingham <br /> and the Trustees prior to that date, it would .be necessary for me to <br /> advise the Trustees to file a Statement of Opposition, even though it <br /> might subsequently be withdrawn. <br /> V. <br /> With respect to your difficulty in obtaining a title policy on the <br /> gravel pit, please find enclosed a copy of my letter of July 18 , 1978 <br /> to Vail-Eagle Title Company transmitting payment for a title policy <br /> and requesting that a policy be sent to your office. Please also find <br /> enclosed a copy of my copy of the policv as issued. I can only assume <br /> the original policy was lost in the mail and suggest you request a <br /> duplicate from Hunter Young at Vail-Eagle Title Company. <br /> I <br /> I <br />
