Page 4 <br />Any such roads may be used by others if such use does not interfere with the Lessee's <br />use. On termination of the Lease, at the Lessors written request, the Lessee, at its sole <br />expense, shall promptly restore the premises disturbed by new private roads to <br />substantially the condition existing before construction of the same. <br />10 Expense of County Road [morovements and Maintenance. The Lessee will be <br />responsible for improving and maintaining and repairing all road damage caused by the <br />haul trucks on the designated haul route. <br />11. Insurance. The Lessee shall carry liability insurance (with the Lessor named as an <br />additional insured) on its operations on the Property, in the minimum amount of One <br />Million Dollars ($1,000,000) for public liability and Fifty Thousand Dollars ($50,000) for <br />property damage liability. However, if such liability insurance is under an overall policy, <br />the base policy shall be in a minimum amount of Five Hundred Thousand Dollars <br />($500,000) public liability plus an umbrella of One Million Dollars ($1,000,000), <br />including public property damage. The Lessee shall, from time to time, upon Lessors <br />written request deliver evidence to the Lessor of compliance with the foregoing insurance <br />provisions. The Lessor shall be liable for public liability or property damage that is not <br />directly associated with mining operations; such as, those arising from farming, hunting <br />clubs, fishing clubs, or other like activities authorized or conducted by Lessor. <br />12. Com~iance with Applicable Laws, Rules, and ReQttlations. In its mining operations,. <br />the Lessee shall comply with all lawful and applicable State and Federal statutes, rules <br />and regulations. <br />13. Indemnification. The lessee shall indemnify and hold the Lessor harmless against any <br />and all loss, liability, damage, and expense whatsoever (including but not limited to [a] <br />all sums paid in settlement of litigation effected with the written consent of the Lessee, <br />and [b] all expenses, including attorney's fees, reasonably incurred in defending or against <br />litigation arising out of injuries and damages caused by Lessee's mining operations and <br />all claims resulting from the negligence of the Lessee or its employees or agents, including <br />subconiractors or assigns. This includes, but not by way of limitation, any damage <br />caused to any imgation ditches on the property. This Lease is expressly subject to the <br />right of ingress and egress for maintenance and repair of any such irrigation ditches. <br />Lessor shall similarly indemnify and hold Lessee harmless for injuries or damages caused <br />by Lessor or its activities. <br />14. Compliance with Colorado's Water Law. The Lessor shall supply the water required <br />for such augmentation up to a maximum of twenty (20) shares of Hill and Brush water <br />owned by the Lessor. <br />15. Compliance with Environmental Law The Lessee shall comply with all lawful <br />environmental regulations and shall indemnify and hold the Lessor harmless from any and <br />1`,J <br />
