This notice <br />alleges that the amendment is being made to "...correct a mistake made in 1992 by the Department of Mineral and <br />Geology for a Hazd Rock/Metal Mines Limited Impact (110) reclamation permit ...". The Van Elias also alleged in <br />letters dated September 26, 2005 and November 6, 2005 (copies enclosed) that the Division of Minerals and <br />Geology (DMG) made a mistake in 1992 and that the DMG should write a letter explaining this to the Board of <br />County Commissioners of Chaffee County. The DMG answered those letters with a letter dated November 14, <br />2005, explaining that we did not make a mistake in 1992 when the application was considered. A copy of this letter <br />that more fully explains our position in this regard is enclosed. <br />It has also come to my attention that the second page of the Notice of Filing Application sent to you by the Van <br />Elias states, in part: "The effected boundaries have been changed from 3 acre to 9.9 acres and has been approved by <br />the Department of Mineral and Geology". Please note that the DMG is presently reviewing the application for <br />amendment and has not approved of said application at this time. Please also note that the DMG did inspect the site <br />on September 23, 2005 (copy of report enclosed) and took Global Positioning System measurements to determine <br />acreage enclosed by stakes placed by the Van Elias.
