<br />ruye 2 <br />ORDER <br />American Soda, L.L.C. having satisfied its burden to demonstrate [hat its application complies with all <br />applicable requirements for a technical revision to Permit No. M-1999-002 for the Yankee Gulch Sodium <br />Minerals Project, the Board hereby orders that the subject technical revision TR-003 is approved, with the <br />following conditions: <br />(a) Ground water in the vicinity of the Yankee Gulch Sodium Minerals Project is subject to <br />regulation through permits issued by the Colorado Mined Land Reclamation Board, the U.S. Bureau of <br />Land Management (BLM), and the U.S. Environmental Protection Agency (EPA). If BLM and/or EPA <br />requires permit conditions protective of ground water that potentially conflict with conditions approved <br />in the reclamation permit, the Operator will contact the Division of Minerals and Geology (DMG) <br />wjthin a reasonable time and cooperate in revising the reclamation permit as necessary to address any <br />conflicting requirements. If BLM and/or EPA impose permit conditions protective of ground water that <br />differ from those in the reclamation permit, but are not necessarily in conflict, the Operator will contact <br />the DMG within a reasonable time and cooperate in the determination as to whether or not revision of <br />the reclamation permit is necessary. <br />(b) The Operator will provide a full report of all ground water monitoring activities by creating a <br />separate section in the annual reclamation report required under § 34-32-1 l6, C.R.S. If evidence of <br />non-compliance with petmit conditions protective of ground water is found, the Operator will follow the <br />Division of Minerals and Geology "Ground Water Compliance Protocol", which is attached and <br />incorporated within this order. If "early warning indicators" listed in attachment 1 to technical revision <br />TR-003 are exceeded in wells that are not designated points of compliance, then the Operator will notify <br />the Division within five (5) working days and cooperate in any further investigations or permit <br />modifications that are determined to be necessary for the protection of ground water. <br />(c) The Operator will provide the Division of Minerals and Geology with a proposal for points of <br />compliance and numeric protection levels for the dissolution surface monitoring of potentiometric <br />pressure and temperature once the dedicated probes are installed and operational. The Operator will <br />also provide a proposal for a separate compliance protocol for the dissolution surface since temperatures <br />
