You agreed to close this road neaz the Forest boundary. I received a letter from <br />you dated 7/11/00 placing certain conditions on the road closure. Approving utility extensions <br />and the tailings pond access have not been approved and will not be a condition of closing this <br />road. Access to these claims from the pathfinder pit on this road is not an approved access point. <br />Therefore this road should be closed as originally agreed. Use of this road to access your claims <br />is not in compliance with your approved operating plan and should cease immediately. <br />After reviewing your approved operating plan (dated 11/28/98 and FS letter dated 12/17/98) I <br />have identified several other activities on the Valley View mill site, Dave Day lode and <br />Millennia claims, which do not comply with this operating plan or the regulations found in 36 <br />CFR Part 228: <br />A street sign entitled "Roden Road" has been placed on National Forest land at the <br />junction of highway 145 and the upper access road to Susan Krammers property, the <br />Dave Day and Millennia claims. This sign is not authorized and must be removed by <br />11/30/00. <br />A street sign entitled "Old Mill Road" has been placed on National Forest land at the <br />junction of Priest Lane and the mill site access road. This sign is not authorized and must <br />be removed by 11/30/00. <br />Numerous loads of mixed waste dirt and rock have been dumped on the Valley View mill <br />site claims. Some of this material has been spread on the site. What is the origin and <br />content of this material? I have a concern as to whether there may be contaminants or <br />hazazdous waste in this material. It is appazent this material is not for construction of the <br />berm, and does not meet the requirement to use topsoil for the berm. This is not in <br />compliance with your approved plan of operations and must cease immediately. Since <br />importing and use of this mateaal is not approved in your plan of operations you must <br />remove it from the site. Please notify me in writing by 11/30/00 as to how and when you <br />propose to remove this material from the claims.
