"maintaining",the county road without the proper permits, King Mountain has a hard time maintaining
fences and keeping their livestock on their property. Given this pattern, combined with King
Mountain's failure to post a financial warranty and to, submit the annual reports and pay the required
fees, .and -the detrimental impact the proposed gravel pit expansion will have on all of the interests
identified by the legislature as requiring protection, the Boazd should deny King Mountain's Permit
Conversion Application. _
C. Conclusion
The Board does not have jurisdiction to take any action with respect to the Permit Conversion
Application filed by King Mountain. Further, King Mountain's proposal has serious economic;
environmental, conservation and other ramifications for Routt County, and its property owners fot
yeazs to come. Therefore, the Boazd should deny King Mountain's request.
Very truly yours,
J ES WM. STOVALL, P.C.
' J s~ Vhm. S ov Y
JWS:be
