<br />Mr. Tom Schreiner <br />January 11, 2002 <br />Page 4 <br />I <br />MASSEY SEMENOFF SCHWARZ St BAILEY, P.C. <br />with an additional structure UDFCD has committed to install in the River <br />downstream of the Bull Seep Slough/South Platte River confluence. <br />^ First Creek Spillway <br />As part of the presently effective Reclamation Plan at the Howe Pit, MPC <br />is required to install a spillway capable of discharging a projected 4800 cfs <br />through the Bull Seep Slough to the South Platte River from Reservoir B. This <br />represents the 100-year flood event on First Creek being routed through <br />Reservoir B. MPC's consulting engineers and the Task Force have spent <br />numerous hours assessing various scenarios for passing such flows through the <br />Bull Seep Slough starting from the northwest corner of Reservoir B (i.e., the <br />spillway location presently designated in the Reclamation Plan). <br />The Task Force has concluded that passing 4800 cfs through the Bull <br />Seep Slough will require a significant channel on the McIntosh property located <br />west of the Bull Seep Slough (i.e., the property that is also subject to the above <br />mentioned Adams County conservation easement), and significant <br />encroachment onto the Hazeltine property owned by the Denver Water <br />Department, but operated by Albert Frei & Sons. In addition to concerns <br />expressed by McIntosh and Denver Water, both the United States Army Corps of <br />Engineers and Adams County have reacted negatively to the spillway scenarios <br />presented. <br />The scenarios evaluated also indicate that the historic flow of First Creek <br />across the Howe property is the course the 100-year event would likely travel, <br />which includes an historic path across both the Hazeltine property and possibly <br />the Roadrunner property as well. As such, moving the spillway from the <br />northwest corner of Reservoir B to a more central location on the divider between <br />the Howe Pit and the Hazeltine Pit seems to make sense. MPC is in the process <br />of initiating more specific discussions with the Denver Water Department and the <br />South Adams County Water and Sanitation District on this point, since these <br />entities will operate the property post-mining. For these reasons, the spillway, <br />which MPC considers areclamation/post-mining feature (and not a drainage plan <br />feature), has not been rendered on the attached Plan. Should you wish to review <br />the spillway scenarios presented to the Task Force, please call me. <br />^ Path Forward <br />MPC has directed its consulting engineers to commence the development <br />of the construction drawings from which the Bull Seep realignment will be <br />accomplished by March 31, 2002 (Section 2.6 of the Board's Order). As <br />mentioned, the next meeting of the UDFCD Task Force will be on January 23, <br />2002. The primary purpose of the meeting will be to discuss the alignment <br />.~ "- <br />
