Permittee wishes to assign the permit to ~ r/' r M ~ .~- ~ ~ (new <br />operator), as Successor Operator ("Successor") and Successor wis>xs to become Successor Pemrittee under the <br />pemrit <br />3. Successor rmdersands that the reclamation plan (the "Plan's requited by the permit sod by applicable <br />Stax laws and regulations has not been completed and is willing to assume full responsibility far the completion of <br />the Plan. <br />V. AGREEMENTS <br />Perrmttee and Suxessot hereby agree, for their own benefit and for the btnefit of the State, such agreements to be <br />effective i~ f~gc upon the approval by the SRte of the transfer of the Permit fmm Permittee to Successor, as <br />follows: <br />1. Successor has inspected the mining a~ reclamation operation to its entire satisfaction a~ i9 fully swam <br />of the oonditioos thereof Successor understands end accepts all of the conditioffi of the Permit. <br />2. Successor will complete the reclamationphur, s~ hereby assume liability for completing suchplanas to <br />all areas heretofore disd¢bed, as well as to all areas hereafter dishnbed. Successor wilt perform atl of the <br />obligations of the Permittee under the Permit which have not heretoforo been performed by Permittee. <br />3. Successor hereby leaders to the State its attached Perfomreace a~ Financial Warranties', which are to be <br />substituted for the Performance and Financial Warranties heretofore filed by the Permittee, effective upon the <br />release of the latter Warranties. <br />4. Successor represent to the State that, to the beat of its Imowledge, information and belief, it is not in <br />violation ofmy of the proviaioffi of the Colorado Mind I.aod reclamation Act with respect to any other operation <br />conducted by it in the Star of Colorado. <br />Permittee and Successor hereby request the Star to consent to the aaaignrrcnt of the Pemrit, [o reoogaize Successor <br />as Successor Operator under the Permit, and to accept the tendered substitute Perfomwace smi Financial <br />Warranties in place of the Warrantles presently on file with the State. <br />
