" ~ ~- <br />Mr. Van Mills <br />January 4, 1990 <br />Page Two <br />We had no knowledge of the mining activity when we purchased the land and since they <br />did not make it a public record we were innocent buyers. This simple fact plus the fact <br />that they cannot now come in and mnke a plan For our property. The time for the program <br />was before we developed it, not after. Our first indication was an attempt to make us stop <br />building roads, which was unsiiccessfcil, and this is the first time we have ever received <br />any information that is now being distributed. Why is this? <br />On Page 2, Pnr. q5 - i tint! more of the same type of innuendos with no basis in fact. <br />There is simply no excuse to reach the crnrolnsion they have bc~ed cr. t!:e true facts at hand. <br />Par. ti6 - It is stated "Since this subdivision has been approved by the Commissioners, <br />this should not be difficult." This statement is an outrage to say the least! What it is <br />implying is that hopefully they can force this clown our throats if need be and to hell with <br />us. Sorry fellows, you are wrong again!! The Commissioners do not have jurisdiction, nor <br />do you. We have complied with all laws, rules, and regulations, and with six of the nine <br />lots sold it would be most. difficult t.o make new rules now. <br />We have been extremely cooperative where we have no legal obligation to do so but this <br />matter is going to end here and now. Everyone concerned needs to be fully aware that the <br />first time our customers are put on notice or disturbed or the first time the Commissioners <br />are put on notice we are going to head straight to the court house with a very large damage <br />suit plus punitive requests. F.ach and every person involved has lost site of some very basic <br />facts and need to be reminded of where we all stand on this matter. <br />This is a prohlem betiaeen Mined Reclamation and Trinidad Basin Mining, not Baldwin <br />Resources Inc. or our property owners. We have only one obligation and that is to be honest <br />with our buyer. We have been and will continue to do so and we will make known all facts <br />to future buyers but other than that this issue is going to end here and now. If not we will <br />utilize our legal rights to see that we are nol; damaged by unfair tactics. <br />I hope this does not anger anyone as it is not personal but this matter is losing its' <br />perspective and we intc!!d ro see that the facts are IL9pt :'er}' clear.
