Objections <br />The public comment period for AM-05 closed on Juiy 3, 2003. During the public comment <br />period, DMG received objections from the following: <br />1. Todd C. Hennis, citizen, dated May 16, 2003, DMG received May 19, 2003. <br />2. Todd C. Hennis, President, San Juan Corporation, dated May 16, 2003, <br />DMG received May 19, 2003. <br />3. Todd C. Hennis, President, Salem Minerals, Inc., dated May 16, 2003, <br />DMG received May 19, 2003. <br />A Pre-hearing Conference was held on August 18, 2003. <br />A Formal Public Hearing on the matter is scheduled for the September 23-24, 2003 meeting <br />of the Colorado Mined Land Reclamation Board. <br />Issues Raised by the Objecting Parties <br />Herein, all references to "the Act" derive from the Colorado Mined Land Reclamation Act, 34- <br />32-101 et sec., C.R.S., revised July 1993, and all references to "the Rules" derive from the <br />Mineral Rules and Regulations of the Colorado Mined Land Reclamation Board for Hard <br />Rock, Metal and Designated Mining Operations, amended August 2001. <br />DMG considered all comments submitted timely. This rationale addresses only those issues <br />that directly relate to the specific requirements of an application, as stated in the Act and <br />Rules. <br />Issues raised by the objecting parties were condensed and synthesized and are represented <br />by italicized bold print, following. DMG's responses to the objections follow in standard print. <br />Comments indicating that the proposed industrial post-mining land use is <br />not appropriate. <br />Rules 3.1.1(1) and (2) address the establishment of the post-mining land use. The Act and <br />Rule state that the operator, in consultation with the landowner, where possible, and subject <br />to the approval of the Board, shall determine the post-mining land use. The reclamation plan <br />must support the post-mining land use. <br />The permit holder, SGC, proposed to modify the post-mining land use from rangeland to <br />industrial because the landowners, Gold King and San Juan Corporation, have indicated that <br />industrial activities will continue beyond the life of the Sunnyside Mine permit. The <br />wastewater treatment plant, permitted under WOCD authority, qualifies as an industrial <br />activity. All of the buildings referenced under AM-05 appear to have potential for beneficial <br />use by the landowner after reclamation is completed. The buildings and water treatment <br />
