Mr. Steven G. Renner 2
would re-evaluate the bond adjustment issue. With that in mind, the
request for an extension of time for the preparation of the
documentation concerning this violation will be granted. AFO is
granting MLRD an additional 15 days after receipt of this letter to
provide that information. At that time, AFO will consider the
information presented and will make a finding as to the appropriateness
of MLRD's response to the TDN.
Until this matter is resolved, AFO requests that MLRD take no further
steps in the bond release process for this mine. The current bond
should be held until this matter is resolved.
MLRD's amended response indicates that the Division will issue Notices
of Violation (NOV's) for violations 2 and 3 of 3 contained in
TDN 91-2-116-4. AFO finds that MLRD's issuance of the NOV's constitutes
an appropriate response to the TDN.
If you wish to discuss the matter further, please contact Steve Rathbun
or me at (505) 766-1486.
Sincerely,
INITIALS: DATE:
Originator: S
Supervisor: ~ ~
Deputy FOD: (/
FOD: V
O~ipr~l Slp~! !p .,'-
ROpFo7 H HArn.~
Robert H.
