Exhibit Page 35 <br />Seeding will be done annually for the life of the stockpile, between 1 April and 15 May. <br />Alternative is to spread and crimp certified weed-free mulch at a rate of 2 tons per acre, crimping <br />to be done with astraight-set disc. Long-term stockpile areas will be seeded as with permanent <br />reclamation mix. General instructions regarding seeding and care: <br />All seedings will be mulched with approximately 4000 Ibs. of weed-free straw spread and <br />crimped into the seedbed to a depth of 4 inches, with tracked equipment. <br />For drilling, a grass drill with depth bands and press wheels to a planting depth of %z to 1 inch <br />will be used. Unless irrigated, seeding will be during the period from 15 October to 15 <br />December (late fall), but depending on weather conditions, may be done as late as 30 April <br />(when free of frost). If irrigation is intended for at least the first full growing season, planting will <br />be done between April and August at the end of mining and reclamation operations for the year <br />for the particular piece of land being reclaimed. <br />Weed control will be mechanical (mowing) after establishment, on or about 1 June (before <br />annual weeds have a chance to seed) for the first year. Other control (chemical) should be <br />coordinated with the land owner and County weed and pest control agency. Use of chemical <br />control will be evaluated on an annual basis, and the agency will recommend specific <br />applications, rates and schedules based on weeds observed and other conditions. Beyond the <br />first year, use of mowing, grazing, and other weed control measures will also be evaluated and <br />carried out in accordance with agency instructions. <br />Livestock need to be kept off all areas for several years after seeding <br />
