<br />backfill as the initial step in reclamation, to create stable slopes, cover shale overburden, and provide a
<br />relatively smooth terrain suited for grazing. This will include filling ravines to expand the top of the mesa, with
<br />suitable toe stable slopes. Backfilling is expected to vary from 1 to 30 feet in depth, based on needs. See
<br />cross-sections in Exhibit E-1. If backfilling is done in areas that are not mined, vegetation and sufficient topsoil
<br />to replace topsoil on the backfilled area will be removed prior to backfilling.
<br />Grading to control erosion, siltation and prevent damage (3.1.5(3))
<br />Grading will be done so that erosion and sediment is controlled on affected lands and so that there is no
<br />damage to areas outside the effected land. All highwalls (mining faces) will be eliminated, and final slopes will
<br />be below the angle of repose to prevent potential slides or other damage on affected lands or outside the permit
<br />boundary. Temporary grading, including berms, rock check dams, swales, etc. may be incorporated during
<br />mining and reclamation as necessary. As much as possible, there will be no discharge from disturbed areas.
<br />Reclamation, as much as possible, will result in a series of closed basins with small (1 acre or less) recharge
<br />basins, rather than having all water flow off the mesa top. In some cases, existing ravines will be filled with
<br />excess overburden to create larger upland, relatively flat areas, for grazing land, and to reduce erosion
<br />downstream.
<br />Performance as soon as feasible (3.1.5(4))
<br />For most of the affected area, the time between initial disturbance and final reclamation will vary from five years
<br />to one year. Because of requirements for work areas (see Mining Plan), some areas will have reclamation
<br />delayed until suitable and sufficient area to relocate plant and stockpile areas is available. Backfilling, grading,
<br />and placement of topsoil should be accomplished within one year of completion of extraction and relocation of
<br />any work areas (including stockpiles) from a given area, with seeding to follow as soon as possible based on
<br />recommendations (See Exhibit J).
<br />Refuse and acid•forming or toxic producing materials (3.1.5(5))
<br />No acid-forming or toxic producing materials are anticipated to be exposed, mined, or processed at this site.
<br />Any excess materials after crushing and screening, including product not processed or sold at the time of
<br />closure, will be incorporated into backfill, except for any stockpile of material left for landowner use after
<br />reclamation and release.
<br />Holes, etc. (3.1.5(6))
<br />There are no drill holes, auger holes, adits or shafts to reclaim.
<br />Maximum slopes (3.1.5(7))
<br />All areas, including basins, former headwalls, and berms, shall have slopes not exceeding 3H:1V. Slopes as
<br />proposed are compatible with surrounding conditions and land use.
<br />Use of farm equipment (3.1.5(8))
<br />As pastureland, no use is anticipated, but slopes are compatible with such use in the area, such as mowing,
<br />seeding, or weed control.
<br />Notice of other backfill (3.1.5(9))
<br />The Applicant will comply with this requirement to notify the Division if other backfill is used.
<br />Prevention of unauthorized release of pollutants to surface water (3.1.5(10))
<br />The Applicant will handle mined material to be disposed of on-site in a way to prevent unauthorized release of
<br />pollutants to surface water, and comply with this requirement.
<br />Prevention of unauthorized release of pollutants to groundwater (3.1.5(11))
<br />The Applicant will handle material mined, handled, or disposed of on-site in a way to prevent unauthorized
<br />release of pollutants to groundwater, and comply with this requirement.
<br />General water hydrology and water quality (3.1.6(1))
<br />Hydrology and water quality issues are addressed at length in Exhibit G. The Applicant will comply with
<br />applicable water and water rights laws and regulations, and water quality laws and regulations. No dredge or fill
<br />in waters of Colorado or the United States is proposed, and no temporary or large siltation structures will be
<br />placed except as required by pennits, and will be removed in accordance with those permits.
