The Powderhom mine <br />presently is not conducting coal mining operations and is proceeding with activities necessazy to <br />implement its reclamation plan. On December 14, 2000, Powderhom received a Notice of <br />Violation from the Colorado Division of Minerals and Geology ("DMG") for an alleged <br />violation over which it has no control. Frontier Insurance Company ("Frontier"), which holds <br />Reclamation Bond #] 08486 for the Powderhor Mine, appazently was decertified by the U.S. <br />Department of Treasury and is alleged to be in noncompliance with State bonding regulations. <br />On January 12, 2001, DMG extended the abatement period through and including March <br />14, 2001. During that period, Powderhom has diligently and timely complied with every <br />requirement of the extension. On March 9, 2001, Frontier met with Powderhom and the State of <br />Colorado in an effort to seek resolution of the NOV. As a result of that meeting, the state is <br />interested in obtaining additional information from Frontier, as evidenced by its letter of March <br />13, 2001, and further clarified in its letter of March 14, 2001. Furthermore, as a debtor in <br />possession in a chapter 1 I banlauptcy, the ability to abate the NOV is complicated by the <br />requirement for judicial approval of certain company decisions. <br />In accordance with 2 C.C.R. §407-2, R. 5.03.03(2)(e), Powderhom formally requests <br />additional time so that Frontier and the State may seek to resolve the issues identified by the <br />DMG.
