It is our <br />understanding that the Division was confused by our correspondence and requests clazffication, as <br />follows: <br />As originally requested on 30 January 2004, and in order to allow adequate time to respond to the <br />Division's correspondence of 6 January 2004, including appropriate engineering evaluation of <br />groundwater and FEMA related concerns, please extend the decision date a minimum of 90 days from <br />11 February. This is in part due to the concern of Anderson Consulting that its initial analysis of the <br />FEMA related concerns may take through April 2004 to complete. <br />Unless unforeseen circumstances present themselves, we believe this will provide sufficient time to <br />gather, analyze and present the engineer's findings in reply to the Division's concerns. It is our <br />understanding that the request for a minimum of 90 days will provide opportunity to request another <br />extention and correspondingly additional time maybe allowed by the Division for good cause shown. <br />Regardless, we will keep the Division appraised of our progress. <br />As a necessary clarification, by this correspondence <br />prescribed 90 days, and understand the extension v <br />cooperation. <br />Varna Companies, nc. <br />aue/ <br />Chr' topher L.
