We <br />believe this will provide the Assessment Officer with some <br />additional data that may prove to be beneficial. <br />The NOV was written for failure to pass disturbed area runoff <br />through a sediment pond before leaving the permit area. This <br />occurred at two locations within Diversion Ditch No. 2, at the <br />outlet of culvert YB-1 and a portion of the ditch immediately <br />south of topsoil stockpile A. This was detected at approximately <br />noon on March 18 during a normal inspection. As part of the <br />abatement, Seneca was required to repair the ditch to stop flow <br />through the breaches by 5:00 P.M. that day. We immediately <br />responded to this and the areas were repaired that afternoon. <br />This area was inspected the next day for verification that the <br />work was completed. <br />The second part of the abatement was to maintain the ditch to <br />ensure it is in accordance with the approved design <br />specifications. The ditch was constructed per the design and most <br />likely larger than what was required. During the fall of 1996, <br />the ditch was functioning properly and all runoff was entering <br />sedimentation pond 010. We will do some additional work on this <br />ditch as soon as ground conditions allow to prevent this from <br />happening again. <br />it appeared that the main cause of the problem in both portions <br />of the ditch were from snow drifts which settled in the ditch <br />itself. During the days the snow started melting, but by night <br />these areas were freezing again. The end sections were completely <br />melted, but the water was not flowing because of the blockage in <br />the ditch by the frozen snow. The water settled in the ditch to <br />where it eventually eroded the side slope and breached. <br />Seneca Coal Company • P.O.
