Cottony <br />Division Director <br />Natural Resource Trustee <br />On January 28, 2004, the Division of Minerals and Geology (Division) received your letter <br />concerning the disturbance at the Powell Gravel Pit. Although the materials contained with the <br />letter are somewhat helpful in identifying the condition of the site prior to issuance of the permit, <br />the information supplied does not adequately define the extent of disturbance or the timeframe in <br />which the disturbance occurred. <br />The following deficiencies and discrepancies were identified in the materials forwazded to the <br />Division: <br />• The aerial photos were not cleaz enough to determine the extent of disturbance at the site <br />when they were taken <br />• The date supplied with one of the aerial photos was sometime in the 1990's. Since these <br />documents aze to identify whether any disturbance has occurred at the site since issuance <br />of the permit on May 12, 1995, a photo taken in the 1990's is not adequate to determine <br />the condition of the site prior to permit issuance. The photo must speciffcally have been <br />taken prior to permit issuance. <br />• Although the annual report contained with the letter identified that mining had not begun <br />at the site in 1998, subsequent annual reports indicate that mining had commenced at the <br />site and that rip rap-sized material was removed from the site. <br />Therefore, the materials received by the Division are not adequate to exclude Mr. Powell from <br />responsibility for reclamation of the site. <br />Additionally, the letter mentions closure of the pit, and therefore might be considered a surety <br />release request for the site. If the letter is intended as a surety release request, the request would <br />have to be denied by the Division.
