If n t so accepted, <br />such request is deemed to be rejected. <br />Article 2 -Term <br />2.1 Subject only to Change Order(s) or the provisions for termination set forth in <br />Article 8 below, Contractor shall, subject to the directions received from DMG pursuant to <br />the MOU, commence the Work on the effective date of this agreement. The term of this <br />Agreement shall be one (1) year unless terminated sooner pursuant to Artik;le 8 herein or <br />extended by Change Order pursuant to Article 1.5 herein. <br />2.2 If Contractor is delayed at any time in the prAgress of the Work by Change <br />Order(s), by labor disputes, fire, unusual delay in transportation, adverse weather conditions <br />not reasonably anticipated, unavoidable casualties, or any other causes or, acts of nature <br />beyond Contractor's control and without the fault or negligence of Contractor, Contractor <br />shall prepare and submit to DMG and BMRI within five (5) calendar days oflthe occurrence <br />a written report of its assessment of the occurrence and any proposed am@ndment to the <br />Term. Contractor shall proceed with due diligence to alleviate any such delay and shall <br />continue in the performance of its obligations hereunder. DMG in consultation with BMRI <br />may determine after the receipt of such notice of delay from Contractor, whether to <br />J <br />-5- <br />
