Long <br />2768 Compass Drive D~msion Director <br />Grand Junction, CO 81506 <br />RE: NOV C-94-030 <br />North Thompson Creek Mine (C-81-025) <br />Dear Mr. Stover: <br />Enclosed is a notice of violation for failure to reclaim ponds P-1, 2, and 7 at the North <br />Thompson Creek Mine. The NOV also cites failure to inspect the same ponds, and failure <br />to provide appropriate spillways on Pond P-1. These issues were identified as concerns <br />during the recent oversight inspection of the mine which DMG conducted in conjunction <br />with the Office of Surface Mining. <br />This office previously indicated, in a letter to you dated September 27, 1994, that these <br />matters would be handled as a permit defect. Upon further consideration, the Division has <br />determined that the ponds are not in compliance with regulatory requirements. <br />Consequently, the enclosed NOV was written. <br />Please note that you may submit comments for consideration in assessment of a proposed <br />civil penalty within fifteen days of receipt of the NOV.
