Specialist: JCS <br />NATURE AND DURATION OF THE VIOLATION(S): County failed to respond to the <br />Division's request for information necessary to establish permit conditions protective of <br />unclassified groundwater by July 1, 1995 although notified to do so some 90 days in <br />advance of that date and of the evidence that there was reasonable potential for <br />degradation o[ groundwater quality in the area of the pit that could adversely affect the <br />local use. Duration, since July 1, 1995, is now 208 days. <br />SERIOUSNESS: <br />Administrative, describe - <br />Onsite damage, describe - <br />Offsite damage, describe - <br />Health or safety hazard, describe -At the time of the original inspection, the <br />County was using the pit as a landfill, which was the approved post mining land <br />use. There was, however, no screening of the materials disposed in landfill and a <br />dead animal was on site intended for burial in the landfill. The pit is unlined; the <br />depth of pit was approved to be 20 feet and the reported depth of groundwater in <br />a domestic water supply well in the same quarter quarter section is 20 feet. <br />HISTORY OF VIOLATIONS IN PAST TWELVE MONTHS: When the possible <br />violation was first presented to the August 1995 Boazd, Costilla County had been found <br />to be conducting unpermitted mining at the Sierra Grande Site on October 25, 1994. <br />Any outstanding corrective actions or civil penalties? The County has still not <br />secured the permit required to abate the above violation. <br />
