Box 1298
Glenwood Springs, CO 81601
RE: MID-CONTINENT LIMESTONE QUARRY -Extension of Time to Clean Up
Hydrocarbon Spills -File No. M-82-121
Dear Ms. Delaney:
In response to your letter of May 23, 1996, requesting an extension of time to clean
up the spills at the Mid-Continent Quarry, the Division understands that barrels were
found tipped over at the Mid-Continent Quarry site and that BLM has restricted
access to the site. You have informed us that you have removed these barrels to the
Loadout Facility in Carbondale.
Given these circumstances, the Division will extend the clean up time required in the
Problem Section of our April 30, 1996 inspection report. However, please note that
Mid-Continent continues to be obligated to properly reclaim the Quarry and the
Loadout Facility, which may include cleaning up the spills at the Quarry, as well as
properly disposing of the barrels and other items at the Loadout Facility.
The Division is cognizant of the fact that Mid-Continent may now have obligations
under other laws and regulations concerning this situation. The Division does not
want to interfere with Mid-Continent's compliance with these other laws, but only
wishes to ensure that the sites are properly reclaimed. The Division requests that
Mid-Continent keep DMG informed, on at least a monthly basis, about what actions
Mid-Continent takes, has taken or intends to take to remedy these problems.
