Long <br />Division Director <br />NOV C-96-018 issued to Seneca <br />Permit C-94-082 <br />NOV C-96-018 was issued to Seneca Coal Company by Erica Crosby on <br />11-26-96. It was issued for failure to conduct mining operations <br />within the permit area and implementing a revision prior to DMG <br />approval. The nature of the violation was a cut 1000 feet long, 20 <br />feet wide and 30 feet high adjacent to Routt County Road 27a (RCR), <br />and related fill work to widen RCR 27 which was within the <br />footprint of TR-03. <br />An Assessment Conference was held at the Division's office on <br />February 19, 1997. In attendance at the conference, in addition to <br />me, was Mr. Michael Altavilla and Mr. Charles B. McCulloh of Seneca <br />Coal Company, Ms. Erica Crosby and Mr. James Burnell of the <br />Division of Minerals and Geology Mr. Mitch Rollings of the Office <br />of Surface Mining, Reclamation and Enforcement. <br />Testimony was given by Ms. Crosby and Mr. Altavilla on this two <br />part NOV. Ms. Crosby provided location maps, slides and narrative <br />regarding road widening activities associated with driving a Seneca <br />Coal Company dragline from the Seneca II Mine to the Yoast Mine. <br />RCR 27a was widened using heaving equipment and blasting resulting <br />in the moving of approximately 10,000 cubic yards. This material <br />was placed adjacent to RCR 27 at the intersection of the Yoast Mine <br />Haul Road. The site where material was deposited was included in <br />Technical Revision-03. <br />Mr. Michael Altavilla provided testimony for Senaca Coal Company. <br />He explained in detail discussions that Senaca had with both the <br />Division and the County. The operator submitted a Technical <br />Revision to construct a bypass road between RCR 27 and the Yoast <br />Mine Haul Road. This bypass road would have affected a stock pond <br />and previously undisturbed private property. The bypass was for <br />the purpose of reducing public vehicle delays on RCR 27 and 27a <br />during the moving of the dragline. The Technical Revision also <br />detailed another temporary bypass to allow the dragline to travel <br />
