A ~ <br />2. Mail, within one (I) day a0er receipt of this Notice, to the Mined Land Reclamation Board, written notice of your <br />compliance with paragraph one (I) of this Cease and Desist Order. <br />Complete the following corrective action: Within 60 days, mark the boundaries of the permit affected area by <br />monuments or other markers that are clearly visible, substantial and adequate to delineate such boundaries and, in order <br />to facilitate the Division's inspections, provide a sketch map of the permit/affected area after the boundaries have been <br />marked with the locations of the markers indicated and photographs of the markers attached. <br />4. Pay the Colorado Mined Land Reclamation Board a civil penalty in the amount of $200.00 within 30 days of the <br />signature date of this document. This is based upon a total civil penalty of $6,300.00 being assessed at $100.00 per <br />day for 63 days of violation with $6,100.00 suspended if the corrective action outlined in this Order is completed within <br />60 days. If the cortective action is not completed within 60 days, i.e., by February I5, 1998, the remaining $6,100.00 <br />becomes due and payable at that time. <br />This Cease and Desist Order shall remain in effect until all terms have been satisfied by the operator. <br />In clarification of the rights of recipients of Notices of Violation, Cease and Desist Orders, ponies are advised to consult the <br />Colorado Mined Land Reclamation Act and the State Adminisvative Procedure Act. <br />Nothing herein contained, particularly those portions requiring certain acts to be performed within a certain time, shall be <br />conswed as a permit or license to engage in any prospecting or mining operations within the State. <br />Persons concerned with judicial review of the provisions of this Order aze advised to consult C.R.S. 24-4-106, as amended. <br />~~ <br />Dated at Denver this~~ day of :~~ ~- ~~ <br />COLORADO MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />MICHAEL B.
