Barna. <br />Division Director <br />October 30. 1991 <br />Las Animas County Assessor <br />First & Maple Streets <br />Trinidad, Colorado 81082 <br />RE: Post-Mining Land Use Change at the Trinid6td Basin Mine <br />(Our File No. C-81-048, TR - OS) <br />Dear: <br />This letter is written to notify you of a proposed decision by the Colorado <br />Mined Land Reclamation Division (the Division) to approve a request to change <br />the post-mining land use from rangeland/wildlife to residential on the western <br />half of the Trinidad Basin Mine. The land subject to the proposed land use <br />change includes the west 1/2 of section 15 and the west 1/2 of section 22, <br />T31S, R65W of the 6th P.M. in Las Animas County, Colorado. More specifically <br />the area in questions includes portions of lots 32, 33, 34, 35, 36, 38, 39 and <br />64 of the Del Agua Canyon Ranches. <br />This decision is based in part on Rule 4.16.3 (Alternative Land Use) of the <br />Colorado Mined Land Reclamation Board for Coal Mining. Two sections of this <br />rule which pertain directly to this change include: <br />4.16.3(1) The proposed post-mining land use is compatible with adjacent <br />land use and, where applicable, with existing local, state or <br />federal land use policies and plans: any required approval, <br />including any necessary zoning or other changes required for <br />land by local, state or federal land management agencies, <br />shall be obtained and remain valid throughout the surface <br />coal mining operations. <br />4.16.3(3) The proposed use will not present actual or probable hazard <br />to public health or safety nor will it pose actual or <br />probable threat of water flow diminution or pollution <br />contrary to state or federal laws, rules or regulations. <br /> <br />
