Box 2679 <br />Colorado Springs, Colorado 80901-2679 <br />Re: Mid-Term Review of Somerset Mine, Technical Revision No. 2, <br />File No. C-81-022 <br />Dear Mr. Holmes: <br />iiiiiiiiiiiuiiiiii <br />In response to questions raised during our Mid-Term Review meeting of <br />October 9, 1986, I am amending the stipulations of my September 22, 1986 <br />approval letter. Stipulations 1 and 2 will read as follows: <br />Stipulation Number <br />THE APPLICANT MUST SUBMIT BY NOVEMBER 3, 1986 A DETAILED PLAN FOR SOILS <br />ANALYSIS OF THE ELK CREEK YARD AREA TO VERIFY THE PRESENCE OR ABSENCE OF TOXIC <br />HEAVY METALS, THE TEXTURE AND PARTICLE SIZE DISTRIBUTION OF THE WASTE <br />MATERIAL, AND THE VOLUME CONTENT OF CARBONACEOUS MATERIAL PRESENT. THE SOILS <br />ANALYSIS SHOULD BE DESIGNED 70 ADEQUATELY CHARACTERIZE THE SOILS IN THE ELK <br />CREEK YARD AREA TO A DEPTH OF 4 FEET. THE APPLICANT WITH PROCEED WITH SOIL <br />SAMPLING IN A TIMELY MANNER AND FORWARD RESULTS TO THE DIVISION. THE <br />APPLICANT WILL CONSULT WITH THE DIVISION IN DEVELOPING A FINAL RECLAMATION <br />PLAN FOR THE ELK CP.EEK YARD AREA. <br />Sti ulation Number .2 <br />THE APPL AN M S BMIT TO THE DIVISION BY DECEMBER 15, 1986 A FINAL <br />RECLAMATION PLAN AND COST SUMMARY FOR THE ELK CREEK YARD AREA. AN ACCEPTABLE <br />RECLAMATION BOND FOR THE ENTIRE SOMERSET MINE MUST BE RECEIVED BY JANUARY 30, <br />1987. <br />Jay Smaldone and I will meet on October 21, 1986 to discuss the current <br />reclamation bond. Jay and I will be reviewing the reclamation costs for the <br />Elk Creek, Bear Creek,and Hubbard Creek facilities, and the powerline and <br />powerline road. Hopefully, we will be able to reach a decision on the proper <br />bond amount for those areas.
