i <br />GJrw-~ <br />- ~ cb ~ <br />~_~ 21 ?;,17 , W <br />BEFORE THE MINED LAND RECLAMATION BOARD ;-,~neion, <br />STATE OF COLORADO °~ .:c <br />,,:.~,~ og a„d 3a~n~y <br />FINDINGS OF FACT, CONCLUSIONS OF LAW AND ORDER <br />IN THE MATTER OF THE RECONSIDERATION OF APRIOR PERMIT APPROVAL, <br />APPLICATION OF NICK GRAY, FILE NUMBER M-2005-012 ~/ <br />THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br />Jamiary l0, 2007, in Denver, Colorado for a hearing to reconsider a prior permit approval <br />where the financial warranties were not submitted within 365 days of the original approval. <br />The file number in this matter is M-2005-012. Russ Means appeared on behalf of the <br />Division of Reclamation, Mining and Safety ("Division"). Tim Scanlon oFTMS Consulting <br />appeared on behalf of Nick Gray, the Applicant. <br />The Boazd, having considered the parties' presentations and having been otherwise frilly <br />informed of the facts in this matter, hereby enters the following findings of fact, conclusions of <br />law and order: <br />1. The Applicant proposes to extract sand and gravel from a 41.6-acre site located in Section <br />36, Township 49 North, Range 8 West, 10th Principal Meridian in Montrose County, <br />Colorado. The site is known as the Gray Pit #2. <br />2. The Board has jurisdiction over this matter pursuant to Section 34-32.5-104 of the <br />Colorado Land Reclamation Act for the Extraction of Construction Materials, Section 34- <br />32.5-101 et seq. C.R.S. (2006). <br />3. The Division approved the Applicant's original Section 112 Reclamation Permit on August <br />22, 2005. <br />4. Construction Materials Rule 4.1(2) requires operators to submit financial warranties within <br />one calendar year of an application approval.
