<br />STATE OF COLORADO <br />MINED LAND RECLAMP.TICN BOARD <br /> <br />DEPARTMENT OF NATUR•4L RESOURCES <br />In the matter of: Jack Gilleland <br />C&J Gravel Products, Inc <br />27661 U.S. Highway 160 <br />Durango, CO 81301 <br />Violation No. M-92-031 <br />Suspension of Civil Penalty <br />To: Jack Gilleland and ali other persons engaged in or owning or controlling <br />the following operation: Gravel Pit located in the SE 1/4, Section 16, <br />Township 32 North, Range 7 West of the 10th P.M. in La Plata County, <br />Colorado. <br />FINDINGS OF FACT <br />Pursuant to the authority vested in the State of Colorado Mined Land <br />Reclamation Board by C.R.S. 34-32-123, the 5card hereby makes the following <br />findings of fact: <br />1. On May 26, 1992 in a Formal Public Hearing, the Board found C u J <br />Gravel Products, Inc. to be in violation of C.R.S. 34-3.-109 ;7i <br />for mining ~•vithout a permit. <br />_. The Beard assessed a civil penalry of ;7,300.00 for the above <br />violation. <br />3. The Board ordered tha*. 51,000.00 of the civil penalty be paid <br />~.+i thin 30 days. The Board also ordered that 55,800.00 cf the civil <br />penalty be held in abeyant?, ano That this portion of the penalty <br />~~iouid be revisited at a ocntinuatioc or the hearine regarding <br />progress toward corrective actions specified in the original order. <br />4.
