Long <br />Division Direcl« <br />The Division of Minerals and Geology received Ten Day Notice (TDN) <br />X-94-020-352-006 from the Office of Surface Mining (OSM) on <br />November 21, 1994. The Division has reviewed the facts and <br />identified the TDN as a permit defect, and will resolve the matter <br />as allowed in paragraph 5 of the OSM's Directive INE-35. <br />Ponds 1 and 8 rely primarily on storage of runoff form a 25-year <br />event but, do not have adequate storage capacity to totally contain <br />this runoff. Since the ponds are not designed to totally store <br />runoff from a 25-year event, Powderhorn must revise the pond <br />designs for ponds 1 and 8. The revised designs will need to <br />either, 1) include a combination of spillways as required by Rule <br />4.05.6(3)(d), or 2) account for total containment of runoff from a <br />25-year storm event. <br />Calculations in the approved permit indicate that ponds 2 and 7 <br />have adequate storage capacity to totally contain the runoff from <br />a 25-year event. A revision for ponds 2 and 7 should be submitted <br />to the Division to include a demonstration that these two ponds <br />have the storage capacity required by Rule 4.05.6(6), or provide a <br />combination of spillways as required by rule 4.05.6(3)(d). <br />Powderhorn Coal Company is required to submit a technical revision <br />within 30 days of the date of this letter. The Division will <br />propose a decision on the revision within thirty days of filing. <br />Implementation of any on-the-ground work required by the revision <br />must be completed within thirty days of final approval of the <br />revision. <br />If you have any questions, please feel free to call. <br />
