Long <br />Division Director <br />The Division has modified the original extent of NOV C-95-007 to include haul road <br />sediment deposition in 006 Gulch near the outlet of culvert ME-5. Please find enclosed <br />the modification notice. A description of the modification follows. <br />Rule 4.03.1(1)(6) states that to the extent possible using the best technology currently <br />available, haul road drainage shall not contribute additional suspended solids to <br />streamflow or to runoff outside the permit area. Field conditions observed during the <br />March 28, 1995 inspection and described on page III H of that report, indicate that a <br />violation of 4.03.1(1)(6) had occurred in 006 Gulch, near the outlet of ME-5. Since <br />NOV C-95-007 already cited other violations of 4.03.1(1)(6), we have modified the <br />existing NOV to include this violation rather than issue additional enforcement action. <br />The modification requires Seneca Coal Company to submit a COMPLETE application <br />for technical revision by April 30, 1995, to address appropriate erosion and siltation <br />control measures for the sections of "Mine Entrance" and "A" haul roads that cause <br />additional contributions of suspended solids to streamfiow or to runoff outside the permit <br />area near the outlet of culvert ME-5. <br />Please note that in addition to submittal of a TR, the Division requires excavation of the <br />haul road sediment deposited in 006 Gulch near the outlet of culvert ME-5 and that the <br />excavated material be removed and disposed of appropriately. Haul road sediment <br />previously excavated from ME-5 area and placed on the bank of 006 Gulch shall also be <br />removed. Excavation and removal of haul road sediment from 006 Gulch is to occur by <br />April 20, 1995. <br />
