<br />~._. <br />This section provides in pertinent part: <br />An operator shall obtain a development and extraction permit from the Board <br />for each mining operation. <br />The term "operator" is defined by C.R.S. 1973, 34-32-102 to include: any <br />person, firm, partnership, association or corporation, or any department, <br />division or agency of federal, state, county or municipal government engaged <br />in or controlling a mining operation. <br />CEASE AND DESIST ORDER <br />Based upon the foregoing Findings of Fact and Notice of Violation, and <br />pursuant to the provisions of C.R.S. 1973, 34-32-123, the Board hereby orders <br />you to: <br />1. Immediately cease and desist all mining operations until the <br />amendment to this Limited Impact (110) Permit to allow for mill <br />construction is approved by the Board. <br />2. The above-referenced amendment was approved by the Board at the <br />September 25-26, 1985 meeting; therefore, the Cease and Desist is <br />hereby lifted. <br />In clarification of the rights of recipients of Notices of Violation, Cease <br />and Desist Orders, parties are advised to consult the Colorado Mined Land <br />Reclamation Act and the State Administrative Procedure Act. <br />Nothing herein contained, particularly those portions requiring certain acts <br />to be performed within a certain time, shall be construed as a permit or <br />license to engage in any prospecting or mining operations within the State. <br />Persons concerned with judicial review of the provisions of this Order are <br />advised to consult C.R.S. 1973, 24-4-106, as amended. <br />Dated at Denver this 2nd day of October 1985. <br />MINED LAND RECLAMATION BOARD <br />Department of Natural Resources <br />David C.
