The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, Article 33,
mining operations at the West Elk Mine was considered complete for the purposes of filing. All review and
comment periods as provided in the Act and the Regulations initiate from this date of filing.
The operator proposes to expand the underground mine workings by approximately 1,517 acres and expand the
permit area by approximately 1,767 acres. This land and coal are federally-owned and are located in Gunnison
new disturbance on the land surface is proposed.
The DRMS requests written verification regarding Federal mining leases and/or federal surface access approval.
Mountain Coal Company has referenced the Federal mining lease and/or Federal Surface access agreement COC-
67232 in this application as a document upon which they base their legal right to enter. Please verify that the lease
and/or agreement has/have been issued and that final BLM/federal agency lease/agreement approval has been
granted. If the lease/agreement application is pending, please notify DBMS as to the status of the tease/agreement
review and when a decision is anticipated. Verification of Federal leases and/or federal surface access agreements
should be sent to me at the address listed above.
The underground coal mining operation is on land located approximately 9 miles east of Paonia, Colorado. The
permit area is further described as follows:
