TQ /G l\/` / J <br />/l.. <br />Re: Summit Pressed Brick and Tile Company, <br />Beaver Creek Clay Mine, File No. M-77-322 <br />Dear Mr. Long: <br />Inspection Report, we are by this letter submitting a <br />Technical rPViciOn to provide a more accurate mining map and <br />legal description. The problems noted by Mr. Oehler relate <br />to the inexactness of the topographical map that was <br />originally submitted with our original application, and not <br />to where mining activities occurred or the affected area <br />permitted. <br />I am the attorney for Summit Brick and Tile. In <br />response to your letter of December 13, and Larry Oehler's <br />Summit's application for a permit for this mine was one <br />of the first submittals under the newly adopted Colorado <br />Mined Land Reclamation Act. The mine plan map that Mr. <br />Oehler references in his inspection report was submitted with <br />that application and was basically a drawing on a <br />topographical map with 40 foot contours. It was, as were <br />many others based on the standards applied to permit <br />applications at the time, inexact. The map was not designed <br />to locate specific boundaries of the permit area, and the <br />permit application did not specifically refer to boundaries, <br />but rather to "affected area". The affected area in the <br />permit was designated as 9.9 acres in the NE1/4 of NE1/4 and <br />the NW1/4 of NW1/4 (together with some additional adjacent <br />land). As noted below, the application also contained an <br />aerial photograph of the mine at the time, which more <br />specifically delineated the affected area, and Summit has at <br />all times stayed within the boundaries of what is shown on <br />the aerial photograph, has not exceeded 8.2 acres disturbance <br />at any time, and has not relocated any of its mining <br />operations. The problems noted in Mr. Oehler's report in <br />part result from applying current Division practices and <br />requirements to a 1977 "new law" map. <br />B NIAM ry.
