<br />~, <br />United Companies Interested Parties <br />September 5, 1996 -Revised DMG Recommendation <br />Page 2 <br />Stipulation No. 3 <br />The impervious soil containment of the asphalt batch plant diesel fuel and general use diesel fuel <br />storage near the scale house will be consttvcted to the following specifications: <br />1. The impervious soil plastic index will be a minimum of 10. <br />2. No less than 35% of the soil panicles will pass through a No. 200 sieve. <br />3. The soil with optimum moisture of ±3% will be compacted to 95% of the maximum <br />density. <br />4. The impervious soil layer will be no less than eight inches thick. <br />Each containment facility or reconstructed facility will be tested for all of the above specifications by <br />a certified soil testing technician. The test results will be submitted to the Division within 30 days of <br />construction of the facility. <br />RECOMMENDATION FOR APPROVAL OVER OBJECTIONS: <br />Several objections to approval of the application were received. None of the reasons for the objection <br />would warrant denial of the application based on any potential grounds for denial listed in the Act <br />under Section 34-32.5-115(4)(b) through (g). The Division will calculate an adequate reclamation <br />bond for consideration at the hearing. <br />The Division received several letters listing reasons (issues) for objecting to approval of United <br />Companies' amendment application. The issues are listed below by categories under which they were <br />considered to be adequately answered during the review process. <br />OBJECTIONS NOT WTI'HIN THE JURISDICTION OF THE DIVISION OF MIlVERALS AND <br />GEOLOGY: <br />1. The area is already heavily impacted by mining; <br />2. The application does not propose any specific mitigation of noise, dust, road safety <br />impacts, hours of operation, decreased property values, and eyesores due to inadequate <br />reclamation; <br />3. The gravel pit junk yard obstructs and mars the view of the beautiful Telluride <br />Mountains; <br />4. Air pollution will be a serious contamination problem; <br />
