Cattany <br />Division Director <br />Natural Resource Trustee <br />On October 28, 2002 the Division of Minerals and Geology (Division) approved a Surety Increase (SI-Ol) resulting <br />from observations made during an inspection of the site conducted on September 26, 2002. <br />In a letter dated October 28, 2002, from the Division, Bumgarner Ranches was notified of the increased estimated <br />liability amount from $2,500, to $7,370 an increase of $4,870. The Division has not yet received the additional bond. <br />Rule 4.2.1 (2) of the Construction Materials Rules and Regulations states that >n the event that the Office or Board <br />determines that the Financial Warranty (currently held for a permit) is insufficient to perform reclamation, the <br />Permittee shall have up to sixty (60) days to post additional Financial Warranty from the date of written notice from <br />the Office or Board of such insufficiency. Therefore the additional bond amount of $4,870 was due on December 27, <br />2002. <br />If you have not already done so, please submit an additional bond in the amount of $4,870.00 for the Brig Pit. The <br />deadline for the above corrective action is set for May 5, 2004.
