NOV No. CV-97-012 <br />Dear Mr. Routten: <br />RECEIVED <br />~tN 0 31997 <br />Division of n;inerais s, Geolog, <br />Colorado Yampa Coal Company (CYCC) is requesting an assessment conference with <br />regard to the above NOV issued August 1, 1997. <br />CYCC feels that a seriousness assessment of "significant" as determined by the DMG is <br />excessive. As noted in a letter to Kent Gorham dated August 8, 1997, the ponds <br />associated with this NOV aze visited regulazly by a Registered Professional Engineer, <br />weekly inspections of Pond A and Pond D aze performed to comply with MSHA <br />requirements, and the DMG conducted two inspections during the second quarter. No <br />significant problems were evident prior to the second quarter, nor since the second <br />quarter. <br />CYCC completed pond inspections on July 30, 1997 and August 1, 1997. The inspection <br />forms were mailed on August 1, 1997 and the NOV terminated on August 4, 1997. The <br />`'Time for Abatement" was set as August 31, 1997.
