Box 774288 <br />Steamboat Springs, Colorado 80477 <br />RE: Permit No. 79-177, Midterm Permit Review <br />Dear Mr. McMindes: <br />The Division has reviewed Colorado Yampa Coal Company's (CYCC) response to the <br />midterm permit review. For the most part it looks good, but there are still <br />some remaining questions. These are discussed below. <br />1. The disturbed area tributary to the originally proposed Ponds L and N <br />were diverted into Ponds M and 0. The Division is unable to locate any design <br />plans for Ponds M and 0 which include the additional tributary area for L and <br />N or an engineer certification for Ponds M and 0. <br />2. In response to the Division's concerns about coal fines from Tipple 2 <br />within the Foidel Creek buffer zone, CYCC has stated that there has been no <br />measurable impact of coal dust emissions on the water quality in Foidel Creek <br />as documented in Exhibit 3. However, Figure 3 of Exhibit 3 shows that the TDS <br />and TSS downstream levels are much higher than the upstream levels on Foidel <br />Creek. The coal fine contribution to the elevated levels is unknown at this <br />time, but Exhibit 3 does show a measurable impact on downstream water <br />quality. The Division feels that additional preventative measures are <br />warranted to control the blowing coal fines. The Colorado Air Quality Control <br />Division was contacted about this problem. They will conduct an inspection of <br />the site and provide us with assistance in determining a solution. <br />3. CYCC has requested to relocate the Eckman Park Hi-VoT monitoring <br />station. This was required by OSM Special Stipulation 2. The Division feels <br />that this is a reasonable request, but the Colorado Air Quality Control <br />Division should be contacted. I suggest you talk to Steve Arnold (320-4180) <br />about the proposed changes.
