Re: Ten-Day Notice correspondence pertaining to Raton Creek Mine, Revised
Bond Release Decision, Technical Revision No. 17, and May 9, 1995 Mine
Site Inspection Report
Dear Mr. Iuppa:
in response to our telephone conversation of this afternoon, [ am providing you copies of
the Ten-Day Notice correspondence between the Colorado Division of Minerals and
Geology and the U.S. Office of Surface Mining, as you had requested.
Addi[ionaliy, the Division revised our Proposed Bond Release Decision Document, of which
I am sending you a copy. The revised Bond Release Document eliminates an incorrect
reference to Colorado Regulation Section 2.06.5, page 9 in the original proposed decision
document. Rule 2.06.5 applies to steep slope mining which does not apply at the Raton
Creek Mine site.
For your reference I am enclosing a copy of the proposed decision and cover letter for
technical revision No. 17 explaining the reason a partial approval was proposed. The
Division is unable to approve permanent retention of the pond light-use road until Energy
Fuels Mining Company has provided the appropriate demonstrations and received approval
from the Division for permanent retention of the sediment pond.
While conducting an inspection of the mine site on May 9, 1995, Mr. A.J Iuppa requested
that a copy of my inspection report be forwarded down as well. Please find a copy of my
report included in this package.
I am looking into your question regarding appeal processes for Office of Surface Mining
decisions. I will contact you as soon as I have more information. I have recently placed a
copy of the Colorado Surface Coal Mining Reclamation Act and Regulations on file at the
Las Animas County Public Library to be available for public review and information.
