Catrany Division Director Natural Resource Trustee The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 116, Paragraph 4, of the Colorado Revised Statutes, that on April 15, 2005, an application to revise coal mining operations at the Bowie No. 2 Mine was considered complete for the purposes of filing. The revision was submitted by Bowie Resources, LLC. All review and comment periods as provided in the Act and the Regulations initiate from this date of filing. In Technical Revision No. 40, Bowie Resources LLC (BRL) is proposing to enlarge the holding capacity of Pond B, with the intention of increasing the sediment settling capacity of the pond. The pond will be entazged by excavating to the east. The newly excavated area will be at an elevation that is above the level of the existing primary gated dischazge pipe, so that the surface azea and volume of the existing dead pool of water in the pond will not change. However, the total capacity of the pond will be increased from 4.72 acre-feet to 7.6 acre-feet. About 0.7 acres of new disturbance on Land within the currently approved permit area and owned by BRL will result from this project. The proposed site is immediately adjacent to the east side of Pond B. The excavation will be within 100 feet of the right-of-way of state highway 133B so an opportunity is being offered for the public to request a public hearing concerning the project. Five hundred feet of new guardrail will be installed between the pond and the highway. A Class III Cultural Resources Inventory of the Pond B area was performed in August of 1998. ALimited-Results Cultural Resource Survey Form was completed by your office on August 31, 1998. The underground coal mining operation is on land located approximately 5 miles Northeast of Paonia, Colorado. The pertnit area is further described as follows: Portions of Sections 2, 3, 4, 5, 8, 9, 10, 11, 14, 15, 16, and 22, Township 13 South, Range 91 West of the 6th P.M. Portions of Sections 33 and 34, Township 12 South, Range 91 West of the 6th P.M.
