-3- <br />30ARD ORDER <br />Based on the foregoing Findings of Fact, and Conclusions of Law and pursuant <br />to the provisions of C.R.S. 34-33-124(4), the Board hereby orders that: <br />In order to insure that the irrigation ditch on Mr. Sarver's <br />property is restored to a functional condition prior to the <br />irrigation season, E1,000.00 of the reclamation bond amount is <br />automatically forfeited on May 5, 1989, if the ditch has not been <br />cleaned out to Mr. Sarver's satisfaction by that date. The <br />necessary portion of the E1 ,000.00 is to be used by the Division to <br />ensure the ditch is maintained and properly reclaimed. <br />2. Due to the demonstrated pattern of violations and the failure of <br />the permittee to conduct the operation in compliance with the Act, <br />the Rules and the Permit, Permit C-87-072 is revoked as of this <br />date.
