Dlvi:.on Direcbr <br />Dear Mr. Connell: <br />On June 14, 2001, the Division of Minerals and Geology (DMG) conducted an inspection of your operation and found <br />the following: <br />A 0.2 acre area west of the permit area, between the permit boundary and a fence west of the permit boundary had been <br />disturbed during the course of the'mining operation. Specifically, the DMG believes that this may be a violation of CRS <br />34-32.5-116(4)(1) for failure to protect azeas outside the affected land from slides or damage occurring during the mining <br />operation and reclamation. <br />Therefore, we have reason to believe that a violation exists to the law, the Rules and Permit Number M-1998-058, and <br />have scheduled this matter before the Mined Land Reclamation Board. <br />A Formal Public Hearing will be held during the July 25-26, 2001 Board meeting for cotuideration of possible violation. <br />The hearing will be held in Room 318 of 1313 Sherman Street, Denver, Colorado, beginning at 10:00 a. m. on the first <br />day and 9:00 a.m. on the second day or as soon thereafter as the [natter can be considered. At that hearing you will <br />have the opportunity to be represented and heard. It will be reiterated that there is reason to believe that you are in <br />violation of the provisions noted above. <br />If you wish to have this matter heard at the June 27-28, 2001 Board meeting, please FAX and/or mail, <br />as soon as possible, a waiver of Connell Resources' right to 30-day notice regarding all matters to be <br />brought before the Board. <br />If the Board fmds a violation at [his hearing, it may issue a Cease and Desist Order, assess a Civil Penalty in the amount <br />of $100.00 to $1,000.00 for each day of violation, and/or order the permit be suspended, modified, or revoked. In <br />addition, it may set the matter for forfeiture of the fmancial warranty at a subsequent hearing. If you have evidence <br />indicating that the possible violations noted above do not exist or have been corrected, please provide it [o us as soon as <br />possible or bring it to the hearing.
