Investigation into Continued Damage at the Solitario Ranch Page 6 <br /> <br />r <br />1 <br />1 <br />considered by Basin to be more accurate. The results of this survey were <br />identical to the first in terms of surveying order of accuracy. This information <br />was only brought out during the District Court trial after the judge subpoenaed <br />the files of Mr Mincic. <br />Other Surveys <br />Basin Resources submitted monument survey data on a regular basis to the <br />State of Colorado, Department of Natural Resources. The surveys of interest <br />were those done in Santistevan Canyon, along the railroad tracts over 1N and <br />3N,as well as any other surveys that might have bearing on the Tatum house <br />stability. Some of this survey work was also done by Mincic. <br />The location of the monuments for survey are shown on the Subsidence <br />Monitoring Map submitted to the Department of Natural Resources as part of <br />the permit. The Santistevan Canyon location is less than 2000 ft. north of the <br />Tatum house <br />There was at least one other survey that was made by Basin Resources 4/24/95' <br />that indicated a partial recovery of the land surface. This was explained during <br />the investigation, as set out below. <br />Aguirre Engineers Renort <br />William J. Attwooll P.E., a geotechnical engineer who worked for Aguirre <br />Engineers, Inc. at the time, visited the property and wrote a report and a memo <br />on his observations at the house, both dated March 16, 1985.8 Copies of these <br />reports are included in the appendix. Mr Attwooll also testified at the trial. His <br />conclusion was that the damage to the house, that he observed, was due to coal <br />mine subsidence <br />Madsen. Knegpers & Associates Report <br />John Reins P.E. a structural engineer with Madsen, Kneppers & Associates, Inc, <br />wrote a Report dated May 23, 19959 and a Memo dated June 30, 1995, after a <br />site visit to inspect the house. The conclusion of his study is that the damage to <br />the house is consistent with a conclusion that coal mining was responsible for <br />the damage. This report and memo are included as part of the appendix to this <br />report.
