February 7, 1985 in consideration of the request described as follows: <br />Docket ~5U-84-18/SR 476 Amendr^ent "? - 4!e stern Paving Construction C~ <br />Request: Special Use Review for open mining of sand and gravel in the <br />Agricultural Zoninc District <br />Location: South of the St. Vrain Creek } mile north of Hygiene Road 1# <br />miles east of the Foothills Highway in Section 27, T?N, R70W <br />The following action was taken; <br />The Board of County Commissioners of the County of Boulder, S~:ate of <br />Colorado, APPROVED the request for Special Use with the following conditions: <br />1) All representations of record and in the file will be followed. <br />2) A plan of augmentation for the evaporative loss be approved by the <br />St. Urair, Lefthand Water Conservancy District to allow foi- a well <br />permit to be applied for. <br />3) AT1 other permits necessary for operator are obtained and; <br />4) Any significant deviation frog the rail transportation plan will <br />require rehearing. <br />5) Western Paving in no way interrupt legal rights of ditch company to <br />interrupted flow of water subject to Colorado Water law. <br />6) If the mining operation disrupts or alters the water ave.ilable <br />through the Gregory Springs and pipeline to Ronald Grego^y, the <br />applicant agrees to deliver the same quality and quantity of water <br />through alternate means. <br />. ., ~- 'r <br />~o...e, .
