Lung <br /> Dieision Dueclor <br />Date: May 13, 1996 <br />Re: Permit Revocation -Bond Forfeiture -Civil Penalty Consideration <br />Formal Public Hearing(s) <br />Twin Pines No. 2 Mine (Permit No. C-83-058) <br />During the May 22, 1996 Mined Land Reclamation Board (Board) hearing, the Board will <br />be asked to revoke the Twin Pines No. 2 permit, forfeit the $22,660.00 bond, and consider <br />granting relief from the civil penalties associated with the enforcement actions leading to <br />permit revocation and bond forfeiture. The Twin Pines No. 2 Mine is an underground coal <br />mine. <br />Background <br />Twin Pines Investment, L.P. -Falcon Energy, Inc., General Partner is the permittee and <br />operator of the Twin Pines No. 2 Mine in Fremont County. The total mine permit area, <br />including a loadout facility, is 120 acres, with approximately 9.75 acres of actually disturbed <br />area. The mine ceased all operations on August 31, 1993 as a result of losing its contract <br />with the Canon City Power Plant. <br />The site was reclaimed in 1995. Reclamation tasks completed by the operator included <br />sealing the portals, removal of facilities, backfilling and grading the disturbed areas, <br />redistributing topsoil and revegetating the disturbed areas. Recent inspections have <br />concluded that the site remains stable to date. A Phase I bond release was granted on <br />December 18, 1995 for the backfilling and grading work accomplished by the operator. At <br />that time, the bond liability was reduced from $55,114.00 to $22,660.00. Subsequent to the <br />Phase I bond release, the Division currently holds a bond of $22,660.00 for the site. The <br />site is stable at this time, with no imminent environmental hazards. The portals are sealed, <br />and the sediment control system is intact. Therefore, the Division has determined that the <br />remaining bond is adequate to cover the remaining reclamation tasks associated with <br />revegetation (in the event of failure of the revegetation already accomplished by the <br />operator) and removal of sediment control structures. <br />
