Box 35 <br />Ordway, Colorado 81063 <br />RE: Korinek Sand and Gravel Pit <br />File 1179-131 <br />Dear Mr. Korinek: <br />As I informed you in my letter of March 17, 1982, until such time as our <br />Division has received a reply to the recommendations in my inspection <br />report of November 9, 1981, and the $2,500.00 financial warranty and <br />performance warranty has been received and approved by our Division, your <br />operaCion is not permitted. <br />All mining operators including sand and gravel operators are required to <br />obtain mining and reclamation permits for their mining operations in <br />Colorado by the Colorado Mined Land Reclamation Act, C.R.S. 1973, 34-32-101 <br />et se ., and specifically, 34-32-109(7), as amended. <br />The Mined Land Reclamation Division has placed you and your operation <br />on the Mined Land Reclamation Board meeting agenda for consideration of <br />possible violation of the above mentioned statute. This meeting is scheduled <br />for April 21-22, 1982, in Room 110 of the Centennial Building, 1313 Sherman, <br />in Denver. <br />At the meeting the Board may issue a Cease and Desist Order for your operation <br />at the above cited location per Article 32 of Title 34, Section 123(1) and (2) <br />which states: <br />
