Your cooperation in the matter is appreciaCed. <br />We would like to point out two improprieties with re:,ard to the piC <br />water discharge episode which occurred in late Ma}•. First, under <br />the terms of the permit, any bypass reyuires [he entity to cc•:amine <br />all feasible alternatives to the b}'pass. In this case, inCentionally <br />drawing down Pond C via authorized discharge point 003 so that pit <br />water could have been pumped to Pond L' and thus treated prior to <br />release, appears to be an alternative which a~as not considered. <br />Secondly, and again under tl~e terms of the permit, Division <br />notification prior to any anticipated bypass is required. [de ~oere <br />notified several days after the fact. If the bypass was unanticipated, <br />then the permit requires oral notification within 24 hours of <br />becoming aware of the circumstances. (I believe the bypass in this <br />instance mould be classified as "anticipated.") Regardless, Division <br />notification at the onset was not complied with.
